High Court Directs SIT Not To Take Charmy’s Blood Samples Without Her Consent
Hyderabad: Hyderabad High Court on Tuesday directed that only women officers interrogate Charmy in the drugs case, that too between 10 am and 5 pm.
While disallowing the presence of her advocate during her interrogation, it, however, ordered the Special Investigation Team to collect her blood samples only after taking her permission.
The court said since Charmy is not an accused and only a witness, it was disallowing her advocate to be present during her interrogation. The questioning will be at a place of her choice.
Earlier, she agreed to present herself at the SIT office. But her advocate Vishnuvardhan Reddy said they will decide by evening where her interrogation is to take place.
Earlier, the prosecutor representing SIT called Charmy’s petition a “publicity stunt” and asked why she should have any fear when she has not committed any mistake. He maintained that the investigation will be in accordance with the Narcotic Drugs and Psychotropic Substances Act.
The prosecutor submitted to the court that blood samples of the actress will be taken only after taking permission from her. When the SIT had earlier informed her that the interrogation will take place at a place of her choice, she had agreed to present herself at the Excise Enforcement office.
On the other hand, Charmy’s counsel argued that interrogation of SIT is going on in an illegal manner and sought the court’s permission to allow a lawyer to be present during questioning. He requested the court to ensure that his client’s Constitutional rights are not violated.
